Accordingly, it is a matter for you to satisfy yourself as to the suitability of any agency, employer or job found directly or indirectly through this website.

2, The website, its content and the services provided therein are for personal and non commercial use only. The website, its content and services are provided for the sole purposes of individuals looking for employment and career information and employers seeking to recruit staff.

3, All copyright, trademark, database rights and intellectual rights pertinent to the content of this website, the materials and the services offered therein are the property of Dragon Jobs Ltd and its third party suppliers. Use of the website in no way infers or gives any User any proprietary rights in such materials.

4, By using this website the Users agree not to use the website or the Services to transmit or otherwise, publish or distribute through or post to or on the website any material that may cause offence to other Users or infringe their personal rights. This would include (but not be limited to) material that in our judgment would be defamatory, offensive, indecent, seditious, pornographic, racist, sexist, discriminatory, obscene, vulgar, threatening or otherwise menacing, abusive, untrue, or in breach of confidence, in breach of any intellectual property rights, or would otherwise cause anxiety to other Users.

5, Users are prohibited from attempting to violate or violating the security and integrity of the Website dragonjobs.co.uk, its computer and network systems or any third party computer system, including without limitation, Users may not use any information for other listings or any other commercial or for profit use such as information retrieval services. Users are expressly prohibited from accessing information or data that is not intended for their use, attempting to cause malicious harm to the website its servers and networks, attempting to probe, scan, frame, deep link or otherwise retrieve information that is not intended for the User, or to otherwise cause damage to the website its servers, and the technology that it uses. Users may not interfere with the services and technology used by the website to disable or otherwise interfere with other Users services, networks, servers, domains and hosts without limitation by such malicious activities as sending computer virus’s, blocking bandwidth, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data) or for which you have not obtained all necessary licences and/or approvals. 1, The core services offered by dragonjobs are provided on a free to use basis, however, there are additional services that are and will be made available from time to time via either ourselves or via any of our third party suppliers. These services may require payment to access this will either be by a mechanism of merchant services or such provision as a service such as Paypal. In each instance Users should refer to the payment service provider’s website or their terms and conditions of use of such services.

2, By registering to use the Services pursuant to the terms and conditions laid down, you automatically and hereby grant to dragonjobs a royalty free right to display, copy, reproduce and make available on the Website and otherwise deal with as necessary any material provided to enable us to allow you to use the Services efficiently.

3, Save to the extent required by law, no representations, warranties or terms of any kind are made in respect of the Website and/or the Services or their contents (including, without limitation, any views or comment made). All information and/or data included in and/or on the Website, the Services and/or in any directory or other listings or information retrieval service made available on or by the Website and/or the Services has been so made available for guidance and information purposes only. All liability of dragonjobs, its directors, employees or other representatives or suppliers howsoever arising for any loss suffered as a result of your use of the Website and/or the Services is expressly excluded to the fullest extent permitted by law.

4, Dragonjobs make no warranty that the contents of any and all e-mails communicated through the Site are free from infection by viruses or anything else which has contaminating or destructive properties and shall have no liability in respect thereof.

5, You acknowledge that Dragonjobs is not responsible for third party content on the Website and that Dragonjobs cannot ensure that material presented on the Internet is legal. Dragonjobs will not limit access to material unless notified that it is illegal. In particular, you acknowledge that Dragonjobs is not responsible for and does not monitor the content of job postings provided by third parties on the Website. However, the Company shall have the right to remove any postings, materials or other items on the Website which it believes may be illegal or which it determines to be inappropriate or offensive in any manner to any of its Users,

6, Dragonjobs will not be a party to any communications whatsoever between you and those responding to any use which you may make of the Services, although Dragonjobs reserves the right to monitor any such communications which are made by you or third parties by means of the Website and/or the Services.

7, Save to the extent permitted by this Agreement, Dragonjobs does not grant any licence or other authorisation to use any of its trade marks, product names, company names or logos or any of its copyright works or other intellectual property rights by placing them on or making them available by means of the Website or the Services.

8, Dragonjobs does not promise full, uninterrupted or error free operation of the Website and/or the Services. All liability of Dragonjobs, its directors or employees howsoever arising for any loss whatsoever arising from your use of or inability to use the Website and/or the Services is excluded, insofar as it is possible to do so in law.

9, Dragonjobs may terminate, suspend or deny you access to the Website and/or Services immediately for any reason without incurring any liability whatsoever to you.

Distance Selling

The services provided by this Website are instantaneous and, because of this, use of this Website will under Regulation 13(1)(a) of The Distance Selling Regulations 2000 constitute an exception to your right to reject or cancel the services within seven days of engaging them.

Indemnity

You agree to indemnify Dragonjobs for all losses, costs, actions, claims, damages, expenses (including reasonable legal costs and expenses) or liabilities, whatsoever suffered or incurred by Dragonjobs as a consequence of your breach of this Agreement and/or your use of the Website and/or Services (save to the extent that a court of competent jurisdiction holds that such a claim arose due to an act or omission of Dragonjobs).

Registration

Where you are asked to complete a registration form the personal details that you provide must be true, accurate and complete. You agree to notify us of any changes which are relevant to your registration.

Force Majure

Neither party shall be liable to the other, for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable control including without limitation any power failure.

Termination

Any notices shall, unless otherwise expressly stated, be in writing and shall be given by sending the same by e-mail, first class post, or facsimile transmission to the other party's address as may be designated in writing from time to time. Any notice sent by first class post shall be deemed (in the absence of evidence of early receipt) to have been delivered two days after dispatch. Any notice given by e-mail or facsimile transmission shall be deemed to have been delivered on the next working day following transmission.

Assignment

This Agreement shall be personal to you and you may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without Dragonjobs's prior written consent.

Dragonjobs reserves the right to assign or transfer all or any of its rights and obligations under this Agreement to any other third party. In the event of assignment or transfer, notification will either be given to you by e-mail or posted on the Website.

Failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.

If any provision of this Agreement or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.

This Agreement (together with any variations to it) constitutes the entire agreement between the parties in respect of its subject matter.

Dragonjobs reserves the right to vary this Agreement from time to time. Such changes shall either be notified to you by e-mail or posted on the home pages of the Website. Changes in this manner shall be deemed to have been accepted if you continue to use the Website and/or the Services after a period of two weeks from the date of transmission of the e-mail or of posting on the home pages of the Website, whichever occurs later.

Applicable Law

This Agreement shall be governed by the laws of England and Wales and you hereby submit to the exclusive jurisdiction of English Law and the English courts.

Restriction

The Website services are not available to, and may not be used by, persons under the age of 16 years of age, or who are temporarily or indefinitely suspended Website members. If you are under 16 years old, you can use this service only in conjunction with the supervision of a parent or guardian. If you are a business entity, you represent that you have the authority to bind that entity to this Agreement.

Dragonjobs will fully co-operate with any law enforcement authorities or court order requesting or directing Dragonjobs to disclose the identity or locate anyone posting any material, misusing the Website or otherwise purporting to breach the law.

Should there be a contravention of any Law or the terms and conditions of this website Dragonjobs may terminate its service to you, with incurring any liability.

Dragonjobs accepts no responsibility or liability for the use by any agency, employer or other third party of any CV about you forwarded to any agency, employer (whether by Dragonjobs or you) or to any third party which comes to your attention directly or indirectly through your use of this Website.

If you apply for any job or jobs using the Website you consent to Dragonjobs monitoring and storing the information provided, along with the contents of any email.

Use of candidate database

Employment agencies and employment businesses

If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.

Rights in the database

Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to Dragon Jobs Ltd. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.

Use of the database

The material you are entitled to receive from the candidate database is determined by the product you have purchased from us. On receipt of this material you may:

i. Use, search or download it to your database using the Candidate Search back office interface and its associated functions for the purpose of finding suitable candidates for specific job vacancies that you or (if you are an employment agency or employment business) your client wish to fill.

ii. Use the information about the individuals contained in the database for the purpose of contacting them (either directly or through dragonjobs.co.uk depending on the product you have purchased) in relation to a specific job vacancy.

iii. Use the information only in connection with your own recruitment-related activities.

You may NOT:

i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.

ii. Download the database through any automated (e.g. "scraping") process.

iii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.

Deletion of database material

You agree to delete all material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first.

Links

Dragonjobs does not make any representation as to the security, quality or propriety of any website which may be accessed through this Website. Linked websites accessed through this Website are independent websites over which Dragonjobs does not exercise any control, whether financial, editorial or any other kind and are not in any way endorsed by Dragonjobs.

Accordingly, Dragonjobs has no responsibility or liability to you in respect of any products or services purchased or obtained by you from any such linked website nor in respect of the use of any personally identifying information by any such linked website or its owner. If you decide to access any of the third party websites linked to this Website, you do so entirely at your own risk.

You shall not link to this Website without the express written permission of Dragonjobs.

If you have been granted permission to link to this Website, you may only do so on the basis that you link to, but do not replicate, the home page of this Website, and subject to the following conditions:

Disclaimer

All competitions, promotions and prizes offered by Dragon Jobs Ltd are only open to individuals who register their CVs. All Entrants must register for the relevant Competitions by giving their correct name and email address. No employee or relative of an employee of Dragon Jobs Ltd is entitled to enter this competition.

For the purposes of the Data Protection Act 1998, you acknowledge that in the course of entering a Competition on this Website, certain personal information or data about you will be captured electronically or otherwise and transmitted to Dragon Jobs By entering into any Competition, you expressly agree to transfer such personal information or data to Dragon Jobs Ltd.

Dragon Jobs Ltd. will not offer cash alternatives in whole or in part for any prizes offered. An Entrant may only win one prize per Competition. Entries to any competitions are limited to one per individual. Fraudulent, illegible, multiple or incorrectly completed entries will be disqualified and no responsibility can be accepted by Dragon Jobs Ltd. for any delayed, lost or misplaced entries.

Prizes are allocated randomly from correct entries received unless otherwise stated on the Website. The Judge's decision is final and no correspondence will be entered into. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied remain the property of Dragon Jobs.

We reserve the right to: modify or withdraw, temporarily or permanently, the competition with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the competition.
